Welcome to the terms and conditions page of Agadir My Way Tours (referred to as “the Company,” “we,” “us,” or “our”). By accessing or using our website, agadirmywaytours.com (the “Site”), and/or booking any of our tours or services (the “Tour”), you agree to be bound by these terms and conditions (the “Terms”).
PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITE OR BOOKING A TOUR.
Our Site and Tours are designed for individuals who are 18 years of age or older. By using our Site or booking a Tour, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms and comply with them.
We may update these Terms occasionally. Any changes will be effective immediately upon posting on the Site. It’s your responsibility to review the Terms regularly. Continuing to use the Site or booking a Tour after any changes are posted means you accept those changes.
We strive to keep our Site and Tours available and up-to-date, but we reserve the right to change, suspend, or discontinue any part of the Site or any Tour at any time without notice. We will not be liable to you or any third party for any such changes.
Tour prices are listed in Moroccan Dirhams (MAD) or US Dollars (USD) per person unless otherwise noted. Prices are based on current operating costs, including fuel and other expenses, and may change without notice.
Full payment is required at the time of booking. We accept payments by credit card (Visa and Mastercard) and bank transfer. Credit card payments may incur a processing fee.
To cancel a Tour, you must send a written notice to contact@agadirmywaytours.com. Our cancellation fees are as follows:
– More than 14 days before the Tour start date: Full refund minus a 10% processing fee.
– Between 7 and 14 days before the Tour start date: 50% refund.
– Less than 7 days before the Tour start date: No refund.
If we cancel a Tour for any reason, you will receive a full refund.
We may need to modify Tour itineraries for various reasons. We will notify you of any significant changes as soon as possible. However, we are not responsible for any costs or damages incurred due to these changes, such as missed flights or connections.
For your safety and the safety of others, please follow all instructions from our Tour guides. We reserve the right to remove any participant who is disruptive or fails to comply with these instructions. In such cases, no refund will be provided.
You are responsible for your personal safety and the security of your belongings during the Tour. Agadir My Way Tours is not liable for any loss, damage, or injury you may experience during the Tour.
To the fullest extent allowed by law, Agadir My Way Tours will not be liable for any loss, damage, or injury resulting from participation in our Tours. This includes but is not limited to acts or omissions by third parties, such as other Tour participants, guides, or service providers.
These Terms and any disputes arising from your use of the Site or participation in our Tours are governed by the laws of the Kingdom of Morocco. Any disputes will be resolved through binding arbitration in accordance with the Rules of Conciliation and Arbitration of the International Chamber of Commerce, conducted in Marrakech, Morocco, in English.
These Terms constitute the entire agreement between you and Agadir My Way Tours regarding your use of the Site and participation in our Tours. If any part of these Terms is found invalid or unenforceable, that part will be enforced to the maximum extent possible, and the remaining provisions will remain in full effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations under these Terms at any time.
These Terms do not create any agency, partnership, joint venture, or employment relationship between you and the Company.
Any rights not explicitly granted to you in these Terms are reserved by Agadir My Way Tours.
